1. Service Description

Dutch 30% Ruling ("we," "us," or "our") provides professional application preparation services for the Dutch 30% ruling (Expat Scheme) administered by the Belastingdienst (Dutch Tax and Customs Administration).

What We Do

Our services include:

• Eligibility assessment based on your personal and employment circumstances
• Preparation of application forms and supporting documentation
• Pre-filled PDF forms ready for submission to the Belastingdienst
• Document checklists to help you gather required evidence
• Expert review and personalized guidance (Full Application tier only)
• Email support for questions related to your application

What We Don't Do

Please note that our services are limited in scope. We specifically do NOT:

• File or submit your application to the Belastingdienst. You (or your employer) must submit the completed form.
• Provide traditional legal or tax advice. Our service is application preparation assistance only.
• Represent you in disputes or objections with the Belastingdienst (though we can help you prepare objections).
• Guarantee approval of your application. Only the Belastingdienst can approve or reject your request.
• Handle matters outside the 30% ruling, such as general tax planning, visa sponsorship, or relocation services.

2. No Guarantee of Approval

We prepare your application carefully and professionally. However, the Belastingdienst makes the final decision on approval. Approval depends on your eligibility against official criteria, the completeness and accuracy of your evidence, and the tax authority's assessment.

We cannot and do not guarantee that your application will be approved, even if we assess you as eligible. Factors beyond our control—such as interpretation of eligibility criteria, quality of evidence, or Belastingdienst policy changes—may result in rejection.

3. Pricing and Payment

We offer two service tiers:

• Self-Service: €100.00 (incl. VAT) – Automated eligibility check, pre-filled form, documents checklist
• Full Application: €499.00 (incl. VAT) – Everything in Self-Service plus expert review, personalized assessment, salary verification, document review, and email support

Payment is required in full before work begins. We accept payment via Stripe credit card processing. Payment confirms your acceptance of these Terms of Service.

Prices are quoted in EUR and include Dutch VAT (21%). Invoice and payment receipt will be provided upon completion.

Upgrade Path

If you purchase the Self-Service tier and later decide to upgrade to Full Application, you may do so by paying the difference (€399.00). We will apply your previous payment and credit toward the Full Application service.

4. Delivery Timeline

Both service tiers are delivered within 48 hours of confirmed payment. This means you will receive your completed forms and supporting materials within two business days.

Delivery is via email as PDF documents and a digital checklist. We do not provide printed materials or postal delivery.

If we cannot meet the 48-hour deadline due to unforeseen circumstances, we will notify you immediately and provide a revised delivery date.

5. Refund Policy

Our refund policy is structured to ensure fairness:

Refunds Granted

• Before form preparation: If, during our eligibility assessment, we determine that you do not meet the core criteria for the 30% ruling (e.g., not recruited from abroad, salary below threshold, distance requirement not met), we will offer a full refund of your payment.

Refunds Not Granted

• After delivery: Once your completed application form has been delivered to you, no refund will be issued. The service has been performed and the deliverable provided. You are responsible for reviewing the materials and deciding whether to submit them to the Belastingdienst.
• No refund for rejection: If the Belastingdienst rejects your application, we will not refund your service fee. Our responsibility is to prepare the application correctly; the tax authority's decision is beyond our control.
• No refund for change of circumstances: If your circumstances change after payment (e.g., you change jobs, decide not to apply), no refund will be issued.

6. Accuracy Guarantee

We guarantee that the forms we prepare are completed accurately and correctly based on the information you provide to us.

However, you are responsible for the accuracy and completeness of the information you provide. If you give us incorrect or incomplete information, and this results in an error on your form or rejection by the Belastingdienst, we are not liable. You must review all materials before submission and notify us of any errors we should correct.

We will correct any errors caused by our misinterpretation of your information at no additional cost. Such corrections must be requested within 7 days of delivery.

7. Limitation of Liability (Critical)

OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT YOU PAID FOR THE SERVICE (€100 or €499).

Under no circumstances will we be liable for:

• Indirect damages, consequential damages, or special damages
• Lost tax savings, lost income, or lost employment opportunities
• Penalties or fines imposed by the Belastingdienst
• Any damages arising from the Belastingdienst's decision to reject your application
• Damages resulting from your failure to submit the application or submit it late
• Damages from changes in tax law or policy after your application is prepared
• Any liability for third-party claims or disputes

8. Client Responsibilities

To ensure the best outcome, you agree to:

• Provide accurate information: All personal, employment, and financial information you provide must be truthful, complete, and current.
• Submit the application: You (or your employer) are responsible for submitting the completed form to the Belastingdienst. We do not submit on your behalf.
• Meet the deadline: You must submit your application within 4 months of your employment start date to maximize the retroactive effect of the ruling.
• Gather supporting documents: You are responsible for collecting and submitting evidence (employment contract, passport, proof of residence, salary records, etc.) as indicated in our checklist.
• Review all materials: Before submitting, review all forms and documents carefully. Notify us of any errors within 7 days if you find mistakes.

9. Intellectual Property

Your prepared form belongs to you. Once delivered, you own the completed application materials and may do with them as you wish, including submitting them to the Belastingdienst.

Our website content, templates, and tools remain our property. You may not copy, reproduce, or reuse our materials without permission.

10. Governing Law and Disputes

These Terms of Service are governed by the laws of the Netherlands. Any disputes arising from your use of our service or these terms shall be resolved in the courts of the Netherlands.

11. Modifications to Terms

We reserve the right to update these Terms of Service at any time. Changes will be posted on this page with an updated effective date.

Your continued use of our service following any changes constitutes your acceptance of the modified terms. We recommend reviewing these terms periodically.

Major changes that affect your rights may be communicated via email or prominent notice on our website.

13. Entire Agreement

These Terms of Service, along with our Privacy Policy and any other policies posted on our website, constitute the entire agreement between you and Dutch 30% Ruling regarding your use of our services. If any provision of these terms is found to be unenforceable, the remaining provisions shall remain in full effect.
